By accessing Pearl Shiny’s website, you are agreeing to be bound by these Terms & Conditions, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this website.

Eligibility for use of services or programs

In order to use Pearl Shiny’s services or programs, you must be 18 years of age or older. By using Pearl Shiny’s services or programs, you represent, warrant and covenant to Pearl Shiny that you meet the foregoing eligibility requirements.

Pearl Shiny reserves the right to refuse service, terminate a client relationship, or otherwise cancel orders at our sole discretion.

Payments are due in full before services are rendered.

Pearl Shiny reserves the right to refuse to accept any program applicants, suspend program clients, or otherwise terminate program access at our sole discretion. Pearl Shiny is under no legal obligation to accept anyone that applies to its programs or provide access to the programs. Acceptance to a program is needed to be able to access it.

Refund Policy 

Pearl Shiny’s refund window is within 48 hours (2 days) after purchasing a service product. After the 48-hour (2-day) refund window has passed, Pearl Shiny won’t be able to refund a service product.

Client Unresponsiveness 

Pearl Shiny’s service products are considered complete within 1 month from the date of purchase, unless otherwise extended by prior written agreement, regardless if you fail to follow through on your participation in the service delivery (being unresponsive to emails, not sharing documents, not showing up to videoconference sessions, etc.). 

Income share agreements

Candidates must sign an income share agreement prior to being admitted to Pearl Shiny’s program. The income share agreement will be a contract between the admitted program client and Pearl Shiny for 12 months (1 year). Under the income share agreement, Pearl Shiny’s program will be free, until the program client starts working at a job. Then, the program client will pay Pearl Shiny back monthly a small percentage (10%) of his/her initial income for just 12 months (1 year). 

If the program client is unable to land a job during the 12 month (1 year) period that the income share agreement is in effect, then the program client can waive the income share agreement and pay nothing. 

Once an income share agreement is singed and has been submitted to us, it immediately enters into effect.

Program clients have 7 days (1 week) to withdraw from the program. If 7 days have passed, the income share agreement will be valid for the remainder of the year after entering into effect. Meaning the program client can withdraw from the program and waive his/her income share agreement after 12 months have passed and he/she has been unable to receive a job offer during that time. 

In rare exceptional circumstances, we may approve withdrawals before the 12 months have passed, this is at our sole discretion. However, the program client will be required to pay a withdrawal fee. The fee is $225 for every week the client was in the program, including the 1 week trial period, this will help compensate Pearl Shiny for the time and resources invested in every program client. 

Job search responsibility

Pearl Shiny offers no verbal or written promise or guarantee of landing a job or promotion as a result of our services. We have no control over the market.

For all services purchased or programs enrolled in, you acknowledge that this is a collaborative process between us. You also agree to perform suggested activities to generate the best job search results. Without your engagement in the process, the results will not be what you desire.

Ultimately, your success in the job market is solely your responsibility. Pearl Shiny is no liable for any damage caused by omissions, false statements, or inaccuracies on completed career documents for our clients. We will work with you through the document edit phase. However, as the client, it is your responsibility to review and finalize your career documents before using them.

Payment processors

Pearl Shiny uses Stripe, Inc. or PayPal as third-party service providers for payment services (card acceptance, payment, merchant settlement, and related services). We reserve the right to change and/or add payment processing options.

By purchasing a service or applying for a program, you agree to be bound by Stripe’s privacy policy and by PayPal’s privacy policy, you also hereby consent and authorize Pearl Shiny to share any information and payment instructions you provide with one or more third-party service provider(s) to the minimum extent required to complete your transactions. You also agree to be bound by Stripe’s Services Agreement and by PayPal’s Services Agreement, where applicable.

Privacy

We respect your privacy and the use and protection of your personal information. Our information collection and use policies are set forth in our Privacy Policy. We encourage you to read the Privacy Policy and to use it to help make informed decisions.

Revisions and errata

The materials appearing on Pearl Shiny’s website could include technical, typographical, or photographic errors. Pearl Shiny does not warrant that any of the materials on its website are accurate, complete, or current. Pearl Shiny may make changes to the materials contained on its website at any time without notice. Pearl Shiny does not make any commitment to update the materials.

Pearl Shiny’s website may contain links to other websites and platforms that are not operated by us. If you click on a third party link, you will be directed to that third party’s website or platform. We strongly advise that you review the privacy policy of every site you visit.

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third party websites, platforms, or services.

Modifications to our terms & conditions

Pearl Shiny may revise these terms & conditions of use for its website at anytime without notice. By using this website you are agreeing to be bound by the most recent version of these terms & conditions.

Governing law

Any claim relating to Pearl Shiny’s website shall be governed by the laws of the State of California without regard to its conflict of law provisions.
